Law 2387 /2024 establishes new provisions in relation to sanctions in environmental matters, we remark the following:
In relation to sanctions:
Considers the Written Public Reprimand as a Sanction.
It allows fines to be replaced by Community Service and Mandatory Environmental Courses only when the socioeconomic capacity of the offender is insufficient.
Increase in fines from five thousand (5,000) to one hundred thousand (100,000) current legal minimum wages, over 20 million USD.
Reduction of the fine by 30% for making a confession.
Establishes the following definitions:
Environmental Damage
Compensation measures
Corrective measures.
Procedural Modifications:
Includes the closing arguments stage.
Establishes a new term to determine responsibility and impose sanctions - within eighty (80) days following the expiration of the term to present defenses or allegations.
Establishes the Suspension and Early Termination of the Environmental Penalty Procedure for Environmental Correction and/or Compensation.
Reduces the term of the sanctioning process.
